1. Acceptance of Terms

By accessing and using Pawssible (the "Service," including our website at https://pawssible.ai and mobile application), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to be bound by these Terms, please do not use this Service. These Terms constitute a binding agreement between you and Pawssible ("Company," "we," "us," "our").

3. User Eligibility and Accounts

3.1 Age Requirements: You must be at least 13 years old to use Pawssible. Users under 18 require parental or guardian consent. We require users under 13 to have verifiable parental consent in compliance with applicable laws.

3.2 Account Responsibility: You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities occurring under your account
• Ensuring your information is accurate and current
• Immediately notifying us of any unauthorized access

3.3 Account Termination: We reserve the right to terminate accounts that violate these Terms or engage in illegal activity.

4. Acceptable Use Policy

You agree NOT to use Pawssible for any unlawful purposes or in violation of these Terms. Prohibited activities include:

• Illegal activities in violation of UAE, local, national, or international law
• Harassment, abuse, threats, or discrimination against any person
• Posting false, misleading, or defamatory information
• Violating intellectual property, privacy, or other rights
• Attempting unauthorized access to accounts or systems
• Spreading malware, viruses, or malicious code
• Reverse-engineering or attempting to extract source code
• Automated scraping or data mining without permission
• Using the service for competitive analysis or benchmarking
• Disrupting service availability or functionality

5. Your Content and Pet Data

5.1 Ownership: You retain all rights to your pet data and health information. By using Pawssible, you grant us a worldwide, non-exclusive license to use your data to provide services.

5.2 Data Accuracy: You are responsible for the accuracy of information you provide. Inaccurate health data may result in inaccurate recommendations.

5.3 Sharing with Veterinarians: You control who can access your pet's data. We only share information with veterinarians with your explicit consent.

6. Cost of the Service and Payment Terms

6.1 Free Service: The Pawssible app is provided free of charge to pet owners. There are no subscription plans, recurring charges, or paid tiers for pet owners. Certain features, including the AI assistant, are subject to daily fair use limits that apply equally to all users.

6.2 How Pawssible Earns: Pawssible is funded by commissions and fees paid by business partners — for example, commissions on care service bookings made through the platform (once care services launch), affiliate fees on product recommendations, referral fees from insurance providers, and software fees paid by veterinary clinics. These are paid by partners, not by pet owners.

6.3 Optional Paid Transactions: If you choose to book a third-party care service or purchase a product through Pawssible in the future, the price shown at checkout is the price you pay to the provider. Any such transaction will be governed by terms presented at the time of booking, including the applicable cancellation and refund policy.

6.4 Refunds on Transactions: Refunds for booked services or purchases (when available) are handled per the policy shown at the time of the transaction, with full refunds available where required by UAE consumer protection law. Refunds are processed within 5-7 business days.

6.5 Changes: We will give at least 30 days' notice before introducing any change to how the service is charged. The core app — records, reminders, the pet passport, and the AI assistant within fair use limits — remains free for pet owners.

7. Intellectual Property Rights

All content on Pawssible, including but not limited to text, graphics, logos, images, videos, software, algorithms, and AI models, is the property of Pawssible, our licensors, or content contributors. This content is protected by international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, transmit, modify, or create derivative works without written permission from Pawssible.

8. Limitation of Liability and Disclaimers

8.1 Service "As-Is": Pawssible is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied.

8.2 No Warranties: We disclaim all warranties including:

• Implied warranties of merchantability or fitness for a particular purpose
• Accuracy, completeness, or reliability of content and AI recommendations
• Uninterrupted or error-free service operation
• Absence of harmful code or security vulnerabilities

8.3 Limitation of Damages: TO THE MAXIMUM EXTENT PERMITTED BY LAW, Pawssible SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of revenue, profits, data, or business opportunities
• Pet illness, injury, or death (regardless of cause)
• Data breaches or unauthorized access
• Service interruptions or unavailability

Our total liability shall not exceed the fees you paid in the past 12 months.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pawssible, its founders, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of Pawssible, violation of these Terms, or infringement of any rights.

10. Third-Party Services

Pawssible may integrate with third-party services including payment processors (Tap, Stripe), veterinary directories, and other providers. We are not responsible for third-party services, their terms, or privacy practices. Use of third-party services is at your own risk.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Dubai, United Arab Emirates, without regard to its conflict of law provisions.

Jurisdiction: You irrevocably submit to the exclusive jurisdiction of the courts of Dubai for any disputes arising from these Terms or use of Pawssible. You waive any objections to jurisdiction or venue.

12. Modifications to Terms

Pawssible reserves the right to modify these Terms at any time. Changes become effective when posted to our website. Continued use after changes constitutes acceptance of the updated Terms. Significant changes will be communicated via email or prominent notice.

13. Severability and Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

14. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Pawssible regarding your use of the Service and supersede all prior agreements and understandings.
